The compensatory remedy for inadequate detention conditions was introduced into Russian legislation in 2020. In fact it became the implementation of general measures of the group of judgments of the European Court of Human Rights. The Citizens’ Watch team has analyzed 561 court decisions on compensation for improper detention conditions.
We assessed the adequacy of the compensation awarded in comparison with the average amount of compensation that the drafters of the Law on Compensation were guided by — 231,000 rubles. As part of the monitoring, we identified shortcomings in the functioning of the compensatory remedy, the dynamics of changes in the amount of compensation, as well as the most frequent reasons for improper detention conditions. Our monitoring revealed the ineffectiveness of the compensatory remedy, primarily due to the insufficient amount of compensation, the average amount of which amounted to 24300 rubles in 2023. The results of this work are reflected in a detailed report.
